Wondering - my case was truck out due to my not being able to attend an application hearing, and so I have a hearing to consider an application for the right to appeal coming up. I would appeal on the basis that it is the fault of the other side that I did not attend as they botched organising the telephone conference
THIS application hearing however, has been postponed/adjourned TWICE now due to the other side botching/not turning up.
Can I ask for Summary Judgement in this case? i.e. Judgement in my favour, from application to appeal, to the appeal hearing, to the summary judgement hearing all in one go?
