A 5am start normally isnt something that i would get excited over, and whats more, one that means i have to travel over half of the country on a train certainly doesnt excite me. However, when i look at the trial bundle and see the Claimants name and then look at the abomination they call their case, that does get my attention.

Over the next 4 months i will be facing MKDP on 4 cases which involve Consumer Credit Agreements relating to credit cards. The Claimants claims are so full of holes, holes which i have pointed out to them in the pleadings, and i am optimistic that the Court will draw the same conclusions i have drawn, and when it does then i will be seeking indemnity costs as a consequence.

These cases are so strong in my view that i have agreed to fund them by Conditional Fee Agreement ( No win no fee) and while i appreciate the clients will be left having to fund a modest success fee if the case is successfully defended, they wont be having to pay even 1/10 of the amount claimed.

I will be obtaining the judgment transcripts from these cases, and will be posting the judgments here (as long as i win)

I have just received a County County claim, in respect of a bank loan which I defaulted on. I'm a pensioner and now have to live on benefits, including housing. I live in a furnished flat and have very little in the way of assets. I, even, sold my car, for scrap, over 2 years ago as I couldn't afford to run it any longer.



These people used to phone me constantly and I explained my financial position to them. They have have now decided to sue me. I don't deny the claim but, would hate to have bailiffs come to my flat as my landlord would, probably, ask me to leave. At 72 years of age, the thought of being homeless is making me very depressed.



Please can somebody help me?

Hello everybody, new poster here, and hope someone can help.



I received a CCJ claim form from MKDP a couple of weeks ago (I've already lodged a 28-day ack. of service), and have read plenty of posts about defending etc.

This is for a very old current account with Lloyds Bank, which was closed by them after a long running dispute.

Basically, I moved accounts to RBS after Lloyd's attitude, forgot about the Lloyds one which had a few pounds in it, got debited with charges, into overdraft, charges on charges, same next month, repeated ad infinitum.

Now MKDP have taken to issuing a claim for £1103, entirely made up of bank charges (my actual "borrowing" was virtually nil).

I've successfully defended a MBNA credit card claim recently, but wanted to know how I should approach this, given that it's a current account, rather than a credit card account ? Are there different requests I need to make of them (CPR. SAR) ??
