Bit of background:
i received a CCJ form from Northampton in regards to an old credit card debt held with Lowell for £5000.
i took out the card in 2005 and in my stupidness I completely blew in within a year and basically could not keep up with the spiralling high repayments. Made last payment 2006/2007 and then hid head in sand ignoring every letter from various debt agencies following me from house to house as I moved.
after receiving the CCJ I was convinced it should be statute barred being over 6 years since I last paid. I responded to the court I disputed the CCJ under SB and also phoned Carter/Lowell and explained my defence. They told me I paid £1 on 11/2/2010 so not SB. I disagreed again. Then while off phone scoured my bank statements - no payments of a £1 or any amount on that date.
Court has gone to them with my defence claim of SB and I received a letter from Carters today saying again I paid on 11/2/10 and they are still proceeding with the claim but their client is willing to enter into a Tomlin Order.
i called Carters and demanded the bank details of the alleged payment and they put me on hold for ages and eventually said they need to speak to client again and will be in contact.
unfortunately while rummaging through statements I have found to my horror a payment of £1 in Jan 2010. Not the date they say. I'm absolutely gutted now and terrified what will come next. I must have made the payment in error (paying another telephone banking payee and typed in the wrong code).
what the hell do I do now! I don't even know what a tomlin order is! Help!
