CCJ, When does the Statute Barred period begin?

I received a CCJ claim form with issue date 5th January 2015 earlier this month. It is for an amount of £575.26 and is owed to "Shop Direct Finance Company" for a catalogue account opened in 2008. I have managed to find an old debt letter that I had kept which states the credit agreement date was the 19th October 2008.





Shortly after taking the credit agreement out - and ordering items to the credit limit - I lost my job and as such I was unable to pay the debt back. In fact upon inspection it would appear that I made no payments whatsoever or any written communication to the debtor accepting the debt at all.





I foolishly buried my head in the sand and ignored the debt and despite the odd debt letter here & there I heard nothing until this CCJ claim form came through a few weeks ago.





I have spoken to the National Debtline / Stepchange who have both informed me that the debt could possibly be statute barred due to the fact that payment / communication hasn't been made in over six years.





However upon further reading on the internet I have since read that the six year period could actually either be from the "default" date OR somebody else told me that it could be from the date of the last order I placed with the company. If it is the "default" date, the account wasn't defaulted until the 18th of May 2009 according to my credit file.





I have submitted an acknowledgment of service to give me 14 days extra in which to decide if I wish to defend this claim.





My query is quite simply when does the statute barred period begin? Am I covered under the limitations act or does it look like I will have to accept the debt and pay up?

Bryan carter solicitors have registered a ccj against me for a current account debt they say I had over 5 years ago with lloyds tsb. I wrote to them with a cpr31.14 requesting my

- statement of accounts

- contract

- default notice

- final demand

- assignment





they wrote back to me five weeks later with only my statement of accounts. When I phoned them to see where the other information was, the replied " as they have already gained a ccj against me they had no obligation to send me the other information (contract).





i then spoke to the county court who told me I can pay £150 and try to have the judgement overturned, but there is no guarantee.



Any ideas what I should do next? Is Bryan carter right in saying that they do not have to supply my contract?

I was self employed up till sept last year, when I had a heart attack in a customers home, so I was unable to work for a while, I was buying supplies for work from wholesaler paying on 30 day credit, anyway I missed that months payment of 600 pounds as it slipped my mind, anyway next thing I got letter from Lkny Law saying they had ccj issued and now got pay 1100pounds, just tried calling them to explain and offer to make monthly payment as not worked since sept and they said tough pay the full amount or we when send bailiff's round, so how else can I deal with this?

Hello there I would really like some advice on a old debt of mine. Right here goes, I got a car on finance in October 2006 and paid the repayments for 3 months. On January 6th 2007 my partner at the time borrowed the car and accidentally crashed it. Later on i realised her insurance didn't cover her driving the car. At that point I didn't make no payments or acknowledge any letters or phone calls from the car finance company and the debt defaulted in the march of 2007. 6 years went past and the debt had fell off my credit file. Then to my surprise in June this year I get a letter from Bryan Carter Solicitors acting on behalf of Lowell finance telling me I had 7 days to pay otherwise I would get CCJ forms. True to there word 7 days later I got the CCJ forms to which I defended against claiming Statue Barred. I then get a letter from the court asking me to agree to mediation to hear both sides of the case to which I agreed to, in between all of this I send Bryan Carter the standard S77/78 form of here recorded delivery with a £1 postal order, I have heard nothing back from this. I have now just received a phone call from the court Asking me what date and time I'm available for telephone mediation, i just got an email back confirming the 15th October at 11am. My question is is wha do I do now and what will happen during the mediation when I claim statue barred. On the information I received it says if we can not resolve this matter it will go to the courts. At what point will someone check if this is actually Statue Barred? When I phoned Bryan carter they said to me that I had contact with them in 2010, this is a lie as I have been completely off the radar. I would really appreciate any help and advice and also what I should do next. I just would like to say again though that from the day the car was crashed I made no payment or letter to anyone regarding this debt.
