Hi,

I have two debts with Cabot.They are offering a 10% settlement deal which is just over £100 to clear one of the debts should I accept the deal?

I only have paperwork back to 2012 and don't have the original agreements both debts are from around 2003 defaulted around 2006/2007 I was paying them until March last year so they are not statute barred.

I can record calls so I could call them and see if they will offer the same deal on the second debt or contact them by email.

I really want to clear the debts.I am disabled and my health is poor one of my triggers is stress I could not cope if they visit my home. What is the best course of action?

Hi. I'm just looking for some advice. And I wonder if anyone can help? I wont go into to all of the gory details, but I have 2 credit card debts, one from Aqua, and another from Vanquis. These were originally for £1500, and £1900 respectively, and dated from around 2007-2008.



Over the last couple of years I received maybe half a dozen, in total, letters from Cabot offering to sell me the debts for a reduced rate, and then making general threats and pleas for the outstanding money. I didn't bother replying, thinking that these were just 'sabre rattling exercises'.



In the first week of October though I received a CCJ from Northampton CCBC for £2600, and then 10 days after that another for roughly the same amount. These just appeared out of the blue, with no prior warning and no claim pack for either case. While I was desperately attempting to find out what the hell was happening, a notice of application for attachment of earnings order was also delivered on the back of the first CCJ. All of these court papers were issued on behalf of Cabot, with no reference to the original credit agreement.



At this point I submitted an N244 to my local court for the first CCJ received and and also sent a pair of CCA requests to Cabot. They eventually replied and told me that they didn't have the relevant paperwork on file, but should be able to get it within 40 days. That sort of begs the question. How could they obtain a pair of CCJ's with no proof of debt?



This morning I received a witness statement from Restons in response to my N244, and basically challenging what I wrote in question 10. ie, no receipt of case pack, or letters informing me that I was being taken to court etc. also they enclosed two copies of unsigned letters from a company called Marlin Financial, who I've never heard of, and a copy of a letter from Cabot that I didn't receive either.



So, my situation now, is that I have a brace of CCJ's issued without warning, also issued without claim packs, and therefore with no way to defend them before they originally went to court, I have no copy of any document of assignment, no copy of the original credit agreement, no idea of how they've reached a figure of £2600 on a £1500 credit card debt, and I didn't receive a default notice either.



What I'm trying to find out here is. Do I wait until next Monday (24th November), which is when I have to attend court, and defend Restons claims then? Or can I submit a counter statement to the court before then, or add information to my N244?



Any help would be gratefully received.

Hi. I'm looking for some advice on where to go next with my battle with these lowlifes!! Many years ago myself and my ex had a loan from CitiFinancial. All was going great until I was paid off from my job due to company closure then me and my partner split up. Unfortunately the loan was in my name and I tried my best to keep up with repayments but ultimately I was fighting a losing battle! The loan was taken out in 2004.

Over the years I've had various threatening letters from Cabot Financial who the debt was sold to but I have never responded to them, until at the beginning of July 14 I received a letter off Marlin Financial saying as Cabot had not had any response to their requests for payment, my account had been passed to Restons Solicitors. Of course I received the letter from Restons and boy what a letter it was! Simply put it basically stated that they were seeking immediate payment of the outstanding balance of £4,082.26 or they had instructions to issue a claim against me in the County Court. A questionnaire was enclosed for me to fill in regarding my financial situation. I did not fill this in and return it!!

Someone advised me about Legal Beagles some i had a look around youre site and found enough information to spur me on to send a written request on 10 July to Marlin for a Copy of my Original Credit Agreement and Statements. I included the obligatary £1 fee. I also sent a letter to Restons asking them to put a hold on any claim as there was a dispute on the account and i also enclosed a copy of my letter to Marlin.

On the 15th July Marlin sent me a letter stating they had very little info of me on file and had sent a request to Cabot for the Credit agreement and Statements. I also received a letter off Restons dated 30th July saying the matter had been put on hold until they heard from their clients!!

Well today 24th September i received a letter from Marlin with a Copy of my Credit Agreement from the original creditor CitiFinancial but it states that CitiFinancial have confirmed that Statements for the above account are unavailable!! Please direct all future correspondence to Restons!! So where does this leave me? I have no proof of when the account went into default although I reckon it was about 2005/6 which would make the account Stat Barred anyway as I have made no payments to it and how can a debt collection company demand money from someone when they have no statements of the account to prove how much the person actually owes. I would greatly appreciate some help please as to what my next move should be with Restons as I really don't want it taken to Court. Thanks
