Jacobs, acting without Liability Order can they do this?

dimanche 25 janvier 2015

All,

I have been having a lot of contact with Jacobs, I am finally in a better place now where I can do something about fighting back.

I remember a comment about asking the council for a copy of the original liability order, as without it the whole house of cards falls down. Remember NOT paying Council Tax IS an offence, simply paying LATE is not ;-)

So I sent an email to the council and Jacobs asking for a true copy of the original liability order, council have gone quiet apart from repeating they have transferred the collection over to Jacobs, hmm without a liability order they could be in breach of Data Protection, (FOI Request coming up!) then this from Jacobs themselves, don't laugh legal people!

From what I understand, without a copy of the Liability Order Jacobs cannot act as agents and collect this outstanding council tax, when coupled with the incorrect delivery of their letters, not stating the Liability Order on them or the FULL name of the bailiff, I believe I am right in telling them to jog on! Which means the council have to go back to the courts and request a liability order, at which point the whole, how can you charge £35 for something that costs £6 comes into play, then request a full court hearing

I am currently making small payments of around £50 to clear this so by the time it goes back round they will probably have nothing to chase, only the fees they have tried to apply to what is essentially an unlawful document.

Am I right in the above?

jacobs, removal notice in 24 hours.

jeudi 16 octobre 2014

hi newbie here,

i am in receipt of an enforcement notice from jacobs wich was given to me today.

it is for the sum of 422.00.

it says in big red font "removal 24 hours"

now a little background.

i am 57, disabled and on some serious meds.

i forget things and need reminding to do things.

i have my blue badge for my mobility car.

now , i parked in a bay in burnley which was signposted disabled for all intents and purposes i could tell. the sign was just a cars length in front of me. there were no yellow or white demarcation markings on the ground, just a row of silver studs which i thought were fr partially sighted people tbh.

i received a ticket for parking in a loading bay.

the sign for this was way way behind me at least three car lengths away, nothing on the ground either to indicate this.

anyway i thought i'd challenged it, as i have done before and won.

but today i receive this notice from jacobs.

i am not the best at memory or organisation nowadays due to these meds and my illness.

what can i do now?? i still have the scene photos i thought i'd sent to the council.

it has since been modified with the signs i believe as many blue badge holders were being hit by this terrible signage.

what are my options now?/

there is no way i ca npay 422.00 if my life depended on it.
