Would like some advice as to whether you would advise that i would continue to appeal against a PCN received from Premier Parking Solutions.
The car was parked in a Pay and Display PPS car park, however the car has been parked there on a variety of occasions over the past two months (with no PCN's issued!) as it was advised that the car park was free from an online website, Parkopedia. The car park had no signs previously and it was not Pay and Display. I'm unaware as to when the car park was changed to pay and display, but the signs were obviously there when the PCN was issued.
I have already appealed to PPS and i have refused to name the driver of the vehicle. In the appeal I stated that the PCN was extortionate (as it's £3 to park for 12 hours) and that the car park was not previously pay and display and it was parked there previously for free as Parkopedia states it as a free car park. They emailed back yesterday saying i have to pay the charge of £60 within 14 days or £100 after that, as they didn't accept the appeal.
They have supplied a POPLA code, so I was thinking of taking it further. I was also going to appeal to them with different points, but i would like advice as to whether they would be valid or if i shouldn't appeal at all. The points i was going to make were;
1. The car park was used previously for free.
2. Parkopedia states it's a free car park (checked today and it still says it's free)
3. I am on an apprentice wage so as the keeper of the vehicle it's not an affordable amount if i am made liable to pay it.
4. The price is extortionate compared to the amount you pay to park there (£3 for 12 hours).
5. The photos provided by PPS in the reply to my appeal blatantly shows a nearly empty car park. There are approximately 50 + spaces in this car park and it wasn't busy when the PCN was issued (maybe around 10 cars if that). Therefore nobody else was prevented from parking there.
6. In their reply to the appeal, PPS states 'Vehicles must be parked only in the designated areas', but in the photo they provided with the reply it shows that there are very poor markings showing the designated bays. Are there not any regulations they have to comply with in order to provide a pay and display car park?
7. The website for PPS shows when some of their car parks change to Pay and Display (they publish articles) however this one was never mentioned.
8. When the PCN was issued there were approximately three other cars at least that had been issued a PCN. Therefore they must have also been under the impression that it was free.
