Are pecunary damages necessary before claiming exemplary damages for cold calling?

Section 30 of The Privacy of Electronic Communications Regulations http://ift.tt/1B8i7c6 says:

Proceedings for compensation for failure to comply with requirements of the Regulations

30. (1) A person who suffers damage by reason of any contravention of any of the requirements of these Regulations by any other person shall be entitled to bring proceedings for compensation from that other person for that damage.



A barrister on a phone in programme suggested that compensation might be of the order of £150.



However, is there a concept that one has to have suffered a real financial loss of at least a few pounds (electricity, stamp, lost earning time) to give 'a cause of action' so that one can then claim £150 odd per breach?
