Parking Eye charges - What next? Should I appeal to POPLA?

Hi, my partner has received a parking charge letter from parking eye as keeper but she wasn't driving at the time, i was, she wasn't even with me as I was Christmas shopping.

I am unemployed, have two children and I find the charge is far too excessive especially as its a free car park !

I have prepared an appeal letter and I have used the above template, with a couple of adjustments, and I am wondering if the reasons I give will give me a good chance of a successful appeal,

Here is copy of my appeal:



" I, as registered keeper, wish to invoke your appeals procedure. The driver, whom i am under no statutory obligation to name, was a genuine customer of the stores the carpark is attached to and was also not parked for the duration claimed as they had to, firstly, drive around a very busy car park to find a space, and secondly, was held up leaving by other drivers entering and exiting the carpark.

Also, the car is 17 years old and is not a reliable starter. It can take around 10 mins to start up.

In any event your charges are penal, grossly excessive for a free-to-use car park and not a genuine pre estimate of loss.
