Halifax Not Replied To CCA Request

samedi 7 février 2015

I sent a letter requesting any copies of my CCA agreements under the section 78 act.

I had 2 debts totalling to nearly £10K with Halifax.

One was a credit card I took out in September 2006 (which I believe is unenforceable), and another a loan taken out online in December 2011.

The debts are currently with the Insolvency Exchange which is where I sent the letter to.

I sent the letter recorded delivery on the 19th January.

Ignored the request, so the 12 + 2 days has now expired.

I decided to approach the Financial Ombudsman Service that I was unhappy the bank lent me all this money and I cant pay it back.

I heavily quoted the Lending Code where I believe Halifax breached it and why.

I was on an IVA which is failing; DFD increased payments and I couldn't afford to pay.

The IVA was cancelled in July 2014, and so far I have not had a failure certificate.

I have no money; Halifax are aware of this and I sent them a stinking complaint; they have denied lending me money causing me financial hardship!!

In the meantime, if I start to get any hassle, what can I do as I am disputing the debts?

I am not hoping the FOS will sort it out.
