Morning all,



Looking for a bit of advice on where we stand. The NHBC are decanting us for "approximately" 12 weeks, along with the rest of our street because our houses were all built on an old mine, but the builder, who has now disappeared off the face of the earth (regent builders) has failed to fix



All of our floors are sinking, according to NHBC, they haven't been laid properly - something to do with lack of compacted based before floors were laid, which has resulted in extremely squeaky floors, and floors lowering away from the skirting boards, meaning I can put my hand in between the skirting and floor, and can touch the outside of the walls.



We have other issues, such as we bought a new cooker because the old one seemed to let pots slide off of it, so this was put in - leveled, and within months the pots started to slide off again due to the sloping of the house.



Anyway point is - NHBC are taking the claim on and decanting us while they drive piles into the floors to allow to floors to rest on something, and rebuilding the floors. Meaning great upheaval, and causing us to decant the property while the house is being fixed.



They have offered to pay the difference in housing costs - from rent at the temporary property, to moving costs, subscription TV moving costs etc.



My question is - is there compensation available for the stress and inconvenience caused? I fully understand they have tried to make the upheaval as less stressful as possible, and (by the sounds of it) will be covering any financial loss to us (though we've yet to see any money coming to us) but fact is, we've been living in this house for almost 7 years, complaining all the while, and until my whole street started complaining, we got fed stupid excuses such as "its settlement" or one of my neighbors was told it was caused by his conservatory ( seriously - a conservatory at the back of a house affects your living room floor)



because of this issue, we will now have to declare to house insurance quotes and / or future house sales that the house has been subject to a form of subsidence. We've also had to arrange people to come in and give us quotes on moving, spend time on the phone / internet looking for another property / arranging various things such as moving the TV and phone line at the loss of the 12 month deals we had in place, gas / electricity quotes, council tax reduction / form filling and general upset.



My wife is pretty distressed by all this, she's not sleeping waiting for the countdown of moving day, and try as I might I cant calm her down because she just wants it all over and done with, and I cant make that happen for her. Its a difficult situation and causing stress on our marriage, and affecting her work through lack of sleep. We haven't even reached our one year wedding anniversary yet, and will be spending that in temporary accommodation.



I figured if there was a compensation level - I could use the money to take her away somewhere and relax, and basically sit back and feel satisfied that we got something nice out of the hassle this has caused us for the past 7 years.



We've since found a new issue - this time with the roof leaking, and have reported this to be told its condensation "probably" because our loft is too full, to which we responded it has two suitcases and box in it - and the come back to that was its because we dry our clothes on the radiators and need to invest in a condenser tumble drier.

We have someone coming out at the end of February to look at it, but have been told if the claim is less than £1000 they will not fix it. and have told us it cant possibly be linked to the sinking floors, because the roof sits on a different part of the house from the floors.

Again I fully understand that - but the point being if the builder didn't take due care in fitting the floors, then whose to say they took care in building the foundations? and why,when NHBC came out to drill to investigate the floors, did they drill outside my property and not inside where the issues are?



Any help at all? we cant face being decanted twice over two separate issues, and putting it all off a little longer until both issues can be fixed at the same time will break my wife.



I'm beginning to have my own sleepless nights over this :-(
