Divorce involving 2 properties

Hi there everyone,



I'll try to be as brief as I can:



I will soon be petitioning to divorce my wife in conjunction with resolving financial matters. Child arrangements are already going through the courts as things like they can do have got extremely bitter. With regards to finance issues, there are 2 properties involved, the former matrimonial home & our previous home which my ex mother in law lives in. My ex mother in law has lived in the house (house 2) since 2008, rent free in lieu of looking after our son during the week, so in effect she charges us childminding fees to look after her grandson. During mediation my ex wife has stated that she wishes to keep house 2 until our son is at least 5 years old for no other reason than to protect her mum.



I am not looking at all to move my ex wife or son out of the former matrimonial home but I want financial independence & to be able to fully move on. My question would be is that does the ex mother in law have sitting tenant rights on house 2 because she has been residing there since 2008? She has no contract & it is since 2013 she has paid no rent when my son was born. Both houses are owned in joint names although since July last year, due to my own financial issues, I have not paid half the mortgages, my ex wife has paid the full amounts as I reside in neither property. Any wealth we created was jointly created as we entered our relationship with nothing & I am in effect keeping my ex mother in law in a house whilst my life stalls.
