Hi everyone, I'm after some advice because I'm not really sure how this has happened. My partner mistakenly drove without insurance believing his insurance policy for driving other cars would cover it but as it turns out it didn't and he had an accident. I don't really need to get into the ins and outs of why the insurance didn't cover him as it's been decided and not really relevant to my query.
Basically the MIB was involved and investigated. They settled the other parties claim. My partner still maintains he doesn't believe he was at fault but wanted to just get it over with and as most of the evidence was against him due to him pleading guilty to the motor convictions as he didn't want to pay for solicitors which may not have been the right thing to have done but was meant to be the least costly.
He got the settlement from the MIB who paid the other drivers insurance company for the car costs, the other drivers personal injury claim and costs. The total being around £11,000. He set up a payment plan and has been paying off the agreed amount every month without a problem.
To his surprise he receives a court letter today saying the other driver is taking him to court. Whilst the claim isn't 100% clear on exactly what he is trying to claim for it does appear to be for the vehicle costs as it mentions minus salvage fees. The claim is for around £3900. We are totally confused as to why he's trying to claim for this, as far as we are aware this was all settled by the MIB and he's now paying it back. Can this person submit a claim for something that as far as we are aware he was compensated for already? He had an insurance company working on his behalf and this claim has come via a solicitor directly.
Any advice would be great as we believed this was all done and settled. Thanks
