Faulty Henleys watch

vendredi 27 mars 2015

I purchased a henleys watch brand new from ebay.Within 2 months, the silver coating was ruvbbung off exposing acopper colour metal underneath. The affected areas were the winder, chronograph buttons, side of the casing on both sides and the underneath.I contacted the selelr 3 times before I got a reply from him, and that was only because I threatened court action. He refused to accept the watch back, neither did he offer to replace the watch or refund me,so I sent the watch to him anyway, recorded delivery. He still refused to accept liability, even though I quoted the Sale of gooda Act 1979.It ended in me taking out asummons against him for a measly £29.95 for the watch and £7.15 to return it, as well as the £25.00 court fee..Fast forward a few weeks when he sends me documentation with the name and address on the guarantee of the wholesaler.Up to that point,I never knew any details as the warranty, instruction manual etc were all sent back with the watch.i contacted customer services who offered to send me another watch free of charge. They also stated that they would not expect the coating to come off after 2 months, and all their watches are guaranteed for 122 months. I accepted their offer. However, this still left the out of pocket expenses of around £32.odd. Am I within my legal rights to pursue the remainder of the money from the ebayer who sold me the watch as he is the retailer??
