Help with High Court Enforcement of a CCJ I knew nothing about. (N244)

Hi all! First post here and looking for a little advice.



In late August I received a notice from a HCEO in regards to a judgement granted in Northampton County court in the month of June 2014. I knew nothing of this CCJ and the claimant and HCEO have since confirmed that all prior correspondence were sent to a previous address. The claimant had my email address and have no contact with me since late 2013 when I failed to keep up with a payment arrangement. I did inform the claimant of changes to my personal address in the summer of 2013 but they have no record of this. They have my company details on record and companies house shows my current address and has done since late 2012.



I've since been in contact with the claimant and they have gave me a temporary stay on execution if I can get full payment to them before October 1st. I can get full payment to them and agreed to do so but there is an additional £1000 in costs from the original invoice and my credit rating will be destroyed and there is potential that a CCJ could implicate my employment(not confirmed, haven't wished to bring it up). Therefore I've decided that applying for a stay of execution and the judgement to be set aside is probably the best idea. I don't want to look like I'm going back on my promise but frankly had I received the court papers for the debt I would have promptly arranged for payment to ensure no judgement would have been entered against me.



I have a couple of questions really. The original court of the judgement is Northampton and as such I simply can't walk down to the court and hand the papers over for a decision before October 2nd. Can I present the papers at a local court to stop execution or is this not an option?



Lastly, in the N244 for section 10 do I state that I would be willing to make a full and immediate payment of the original judgement as I would have had the papers been received by myself?
