Restons Solicitors: delaying tactics??? Confused: urgent help needed!

vendredi 24 octobre 2014

Hi all!

In a nutshell here are the facts so far…

· Received claim form from Northampton County Court Business Centre on 17/10/2014 (issue date is 14/10/2014).

· Claimant is Cabot Financial, address for sending documents etc. is Restons Solicitors.

· Sent a CPR 31.14 request by recorded delivery on 20/10/2014 to Restons with a copy (also by recorded delivery) to Cabot. Also sent my acknowledgement of service to Northampton by recorded delivery on the same date requesting more time.

· Received today from Restons a response basically telling me that because I did not sign my letter to them (I printed my name) they are not going to respond to my request and that “please ensure that all documentation is signed failing which we will not acknowledge receipt nor provide any response” (they sent my letter back to me by the way so we can safely say the received it…)

My questions are these:

1. How do I reply??? I thought they had a legal requirement to provide copies of anything they mention in their particulars of claim (I asked for this and other items in addition).

2. I’m confused now about how long I have until I have to file my defence. Last thing I want is for time to run out and Cabot get the CCJ registered against me by default.

3. Is my CPR request legally invalid because I’ve not signed it?

There is a wealth of extremely useful information on this site and I’ve spent several hours trying to find a scenario the same as mine to help me with a reply but with no luck so any help or advice would be much appreciated!

Kind regards.
