How to proceed with suit against an insurance company for not releasing death proceed

I have a friend, 82 year old female. Spouse deceased June 2014. She was named beneficiary of 2 IRA/Annuities with Alliance. This is a 3rd marriage. The children and grandchildren were named beneficiary on all annuities and IRAs. The attorney brought it to the insured's attention that he left his wife out and needed to make changes. Therefore, One annuity beneficiary change form was submitted in Oct 2013 and one beneficiary change form was submitted in Jan 2014. Forms were signed by insured, witnessed by a Financial Advisor and notarized. Alliance received a letter from a disgruntle step-son, June 2014, with allegations and indicated not to release benefits because he was going to sue. To date, the step-son has not hired an attorney or started a lawsuit. Alliance will not release the funds until the step-son provides Alliance the OK to release the funds. He has not submitted any proof to Alliance regarding his allegations. A Demand Letter was sent by an attorney for Alliance to release the money. They are holding firm that they will not release the money until they have the OK by the disgrutle step-son. Can they hold these funds? What should be the next step? Sue Alliance for the proceeds?
