Recently we decided to apply for a new mortgage as our fixed rate was about to end. To our horror we discovered it had been knocked back. We have, we thought, impeccable credit records. After signing up to Experian we discovered that she had a CCJ against her, filed in January 2014, against her old address. Somewhere she hasn't lived for years.
Just to backtrack I believe this is grounded in a PPC 'charge' that she had late 2011/early 2012 but won't know for sure until we get details on the claimant from the court. ATM I don't recall the PPC in question. Upon reviewing sites like this and Watchdog she made the decision to not reply and to bin the letter. She received another, again no reply and binned it. Nothing more arrived and she eventually moved out of that address.
Naturally she's applying for a set aside and we're pretty clear on how to get that started, however, one site that I've read regards applying for a set aside states that she must prove to the court that she notified her 'creditors' of a change of address.
My big question is thus...is a PPC at that stage of trying to pry cash out of people classed as a creditor? My understanding is that there's no 'debt' that that stage, not until official channels such as the council or the courts get involved. At that time, 2011/2012 there was a huge amount of press and online coverage about PPC scams, including as I said above even on Watchdog where the expert they interviewed either tore up the letter or turned it into a paper aeroplane and threw it away, when asked for advice on what people should do if they get one.
I've done a lot of searching, both on here and other sites but cant find a specific answer to this, or even if its a legitimate question that the court will ask about. Right now I'm thinking the best thing to do would be to get a solicitor involved on our side to ensure it goes as smoothly as possible.
Any help is appreciated. As you can imagine this has come as a huge shock to the both of us and whilst we'll roll into a variable rate we just need to get this sorted out before the increased expenditure starts to take its toll.
