I'dlike to ask for some help with a County Court Claim form received from theclaimant Arrow Global Ltd
The claim is issued from the Northampton County Court Business Centre throughDrydensfairfax solicitors on behalf of Arrow Global ltd in the sum of £4,878.35inclusive of court fees and solicitor's costs.
The particulars of claim are as follows:
1. The claim is for the sum of £4,613.35 in respect of monies owing by thedefendant on a credit agreement held by the defendant with Sainsburys Bank plcunder account number xxxxx upon which the defendant failed to maintainpayments.
2. A default notice was served upon the defendant and has not been compliedwith.
3. By virtue of the sale agreement between Sainsbury's Bank plc and theclaimant, the claim vested in the claimant who has a genuine commercialinterest. The defendant has been notified of the assignment by letter. Contact Drysdensfairfax solicitors on 0113 823 3309
The claim pack is dated 02/10/2014 and the notes state that the day of serviceis 5 days after the date shown with a further 14 days to respond so by myreckoning the court must be contacted by the 21/10/2014.
The claim pack was the only document received and there was no other informationor schedules enclosed.
Briefly I had a loan and credit card with Sainsbury's Bank taken out in May2005 (original copy held) and had some personal and financial problems so fellinto arrears although I managed to pay off the credit card. I dealt withBlair, Oliver and Scott the RBS in house recoveries department making paymentsuntil Aug 2010. in July 2010 I received a letter from Apex CreditManagers and until Sep 2014 approx. 25 letters from ten other debtcollection companies until a letter from Drysdenfairfax in Sep 2014 threateningcourt action. Over the last five years I have managed to pay all of mycommitments and have taken out and repaid a number of loans and credit cardswith 100% repayments and now have a reasonable credit record and history and so am very fearful of having a CCJ recorded against me.
Sainsburys Bank assigned the debt to Arrow Global in Aug 2011 (copy letterheld) and it was described as reference: credit card when in fact it wasthe arrears balance of a personal loan.
I have had no verbal or written contact with any of the debt collectioncompanies since May/June 2010 and do not remember receiving the default notice asstated in 2. in the particulars of claim.
They have stated my first name, surname and address correctly but my middleinitial is incorrect on the claim form but this may just be a typing error.
I think I am right in saying that I should acknowledge the claim and enter adefence stating that I have requested further information. i.e. a copy of thedefault notice and a schedule of the debt from the Claimant
Am I right and how do I request further information and should this be from theClaimant or their solicitors?
