Defended claim as statute barred

lundi 30 mars 2015

Hi guys,

claim pack dated 19 feb 2015

I defended my claim as statute barred, got letter from good old solicitors to say I made a payment in July 2009- so asked them to provide proof of payment and they have written back saying that they have received my two letters, one which was for proof of payment I.e payment details and the other was CPR request. They said they are in process of retrieving this information.

Also I written to the claimant(Hoist portfolio) for the CCA, none of which has been received..

today I receive a letter from county court regarding mediation, I presume that our dear old solicitors ( Howard Cohen), have not got this phantom info payment they are talking about..

what should I do should I go in the route of mediation or should asked for it to be strike out..

please can anybody help...

this will be most appreciated

Taking holiday prior to maternity leave

My wife and I are expecting our third child.

The due date is June 7th on the MATB1 form.

My wife has 28 days holiday to take.

She would like her first day away from work to be June 3rd, use her holiday up and then start her maternity leave on July 10th.

Work were fully happy with this (prior to them knowing the due date) but have today said after receiving an email confirming the dates;

" Am I reading it right that you are due on 07/06/2015 and want to start Maternity on 13/07/2015? You cannot take holidays in to your Maternity they have to be before the baby is due."

Is this correct, can she not use up her holiday allowance prior to commencing the maternity period?

Any advice you can offer will be gratefully received!

Thank you

Right to apply for own job

My partner is employed in a temporary contract in the career he has been working towards for years.

The role has been advertised as a permanent position in various locations across the organization including the one he works in. It is the exact role he is doing now. There have been no competency or disciplinary issues. The contract has been renewed once already.

For some reason the job advert now specifies a certain level of competency that my partner is about 8 months off achieving. The competency programme is assesses at set timely intervals I.e. 6 months, 12 months, 24 months etc... So him not having this level of competency officially is to be expected. He is in the role and paid on the pay scale appropriate to his competency.

So effectively he is now unable to apply for his own job because of this new criteria which HR are unable to give a reason for. His colleague in his workplace are furious too as they had assumed once the role was permanent he would step.into it. They work well together as a team and they have been supporting his training and development. We cannot see any logical reason for this criteria. HR will be ringing him back when they find an answer.

All he wants is the opportunity to apply for his own job. If he doesn't get it then fair enough but being denied the opportunity for a pointless reason is so frustrating!
