I hope you would be willing to help me, today I received a court claim form from MKDP LPP regarding a lloyds TSB Credit Card debt of £16,041.80. I have been reading some threads regarding issues will MKDP and court claims and the advice given looks good.
I have had dealing with Capquest back june 2013 and sent them a CCA request, then did not supply the CCA and told me the matter had been closed. I have heard nothing since, until today
Particulairs of Claim
The claiment claims the sum of £16041.80 being monies due from the Defendant to the claiment under a regulated agreement originally between the defendant and Lloyds bank PLC.
The Defendant account number xxxxxxxxxxxxxx and was assigned to the claiment on the 20-06-14, notice of this has been provided to the defendant and no monies have been paid. The defendant has failed to make payments as per the agreement and a default notice has been served pursuant to the consumer credit act 1974.
The claiment claims the sum of £16041.80 plus costs. The complainent as far as necessary, with the pre-action conduct practice direction.
Date of issue is the 19-01-15
No I admit my job means i move round alot but I do not recall any letter sent from MKDP and I certainly do not have an agreement with them. So how could i have missed payments have once requested a CCA from capquest which they could not supply.
I have read a few threads on here as i mentioned so was going to go down the CCA, CPR 31.14 route is this correct?
Also if it does go the court could i get heard in a local court northampton is a far way from me.
