Section 21 Eviction Notice - Deposit Not Protected - Is It Valid?

AST since 1st August 2003, several renewed contracts (pre April 2007) and 2 further rent increases (post April 2007).



Letting agent (property un-managed) served me with a Section 21 today (30.09.14), signed by the landlord, seeking possession after 01.12.14.



My deposit isn't protected and the most recent written tenancy agreement I have found is for the period 01.09.05-31.08.06.



Is this Section 21 notice valid, and if not, how do I dispute it?



I do not seek any financial compensation, I just require more time to find a new home.

Flogas fighting for Bankruptcy PLEASE HELP. In Court on Thursday.

We lived in a property for 18 months which included only one winter. Flogas supplied the property. The landlord had a key to the meter and ordered all deliveries. We first received bills with the wrong meter reading on and it took them 6 months to apply the right reading, again supplied by the landlord. We only had 4 working radiators. All the bills contradicted each other and by the summer of 2011 the bills had jumped from £300 to £2500 which included a delivery of £1500 in the height of summer.During one phone call ,the representative from Flogas even admitted that the meter readings were different from their engineers visits.The harassment from Flogas was unbelievable which included ringing us, giggling and putting the phone down. During this time I spoke to a Mahesh Patel from Flogas who did not at any time decide to tell me that in fact he was a solicitor.I asked him to take us to court as it was going to be the only was forward. Our supply was turned off in September 2011 and a final bill was £4864.81.Because of a work opportunity my husband and I moved to Cornwall. The landlord knew where we had moved to.

In early 2013 we received a CCJ from NCC regarding the debt.After phoning the Court I sent in a substantial Defence. A few weeks later my husband received a CCJ. I phoned the Court and they told me that they had not received my Defence and it may have gone missing. They knew that I had phoned previously.

Then out of the blue a couple called to our property and handed me a document. It was a Statutory Demand from a solicitors called Stenfield and it was signed by Mahesh Patel. I honestly believed it wasn't real especially with my dealings of Flogas. So I ignored it. Stupid I know.

We have been in the Bankruptcy Court four times now. Each Judge has seen the problems with Flogas and suggested to me ( I have dealt with everything, bills ,court etc all along but because of my husband's profile they are going after him) to try and have the CCJ set aside. I tried this but of course it is now out of time.Also Stenfield stated that the Bankruptcy Court is not considered the proper forum for the discrepancies of the bills to be tried.

On appealing to have the Judgement in Default set aside, they have used the ruling 13.3(2) as the overriding objective that the application had not been made promptly. The Judgement was dated 18th April 2013(LOST by the Court) and the application to set aside was not made until January 2014.

I have appealed against this decision using Article 19(4) of the Service Regulation and also applying 13.3(1) to set aside as I have a genuine reason to dispute it and believe I have a real prospect of defending the claim.

The hearing is on Thursday.Is there anything I can apply? We do not owe this debt and my husband is being made bankrupt at the age of 68 after working all his life. Even the Judges are surprised why Flogas are going for Bankruptcy. Our last Judge asked what the point was and that he never heard anything like it before. Of course Stenfield's have never attended, just the duty solicitors. I have even written to the Chairman of Flogas who couldn't be bothered to reply even after telling him that my husband was in the critical unit at Treliske. The secretary said that it was in the hands of their solicitors so they couldn't comment.

Any help would be most appreciated.

Money Claim Online - Case set aside?

Hi,

Im looking for some advice or help. I submitted a claim through the moneyclaim online service. I made a mistake on the form and ticked the box to say i would send "particulars of the claim" to the defendant separetly. However my mistake i didnt read that bit and failed to send them to the defendant. The defendant has filed to set the case aside ( or have it struck out) , i called the court this morning and they advised there will be a hearing which i need to attend. Does anyone have any idea if the claim will be struck out or what i should do to save the situation?

"How does the scam work?"




First, you make contact:-











If you send an email you will get a reply within a day or two. That message will tell you that (in this case) the BSA A75 Rocket 3 is still available and you can have it for £3380, possibly less. The same message will include an email address for you to send your reply (i.e. outside of eBay). If you do send an email, you will be asked again if you are willing and able to buy and pay for the car. Any questions you ask about seeing the car will be swept aside - for example the seller is out of the country. You will be assured that if you pay into a PayPal account (sometimes Google or Amazon) your money will be absolutely secure. This is all pure fabrication but some people fall for it. If you agree to these terms - which include a 7-day money back guarantee - you will be sent an invoice online, and it will appear to have been sent to you by PayPal (or a similar household name like Google or Amazon). The invoice will contain the bank details for you to transfer the amount - £3380 in this case - and the account you will see on the invoice is usually at Barclays, TSB or Lloyds. Once you have sent the money, that's it. You've lost it. No police investigation is likely to take place, and any report to ActionFraud will in all probability result in no 'action' at all. the money will be lost and there is no chance of recovery. The criminals keep a very close eye online on credits to these bank accounts and as soon as a payment is received, they withdraw it quickly - often within an hour and in person. Then the money disappears out of the country.

Restons - Cabot - refuse CPR 31.14 request

Hi there hope you can give me some advice on what action to take. I have received a letter of response from Restons Solicitors in respect of my request pursuant to CPR 31.14 stating that as the claim was issued via the county court business centre they are only required to insert brief details of the claim and they do not have to attach any enclosures. They go on to say that as claim started online they do not have to attach particulars of the contract unless the particulars are served separately in accordance with paragraph 5.2 of this practice direction. They say that I would have been provided with a copy of the contractual terms and conditions at the time the account was opened and see no reason why I should now require an additional copy. Furthermore, other documents I requested are not mentioned in particulars of claim so CPR31.14 does not apply. They say that the particulars of the claim is sufficient information for me to file my defence. I would really appreciate any advice on how to reply to this - I have to file my defence by 10th October. Many thanks

legal advice please help re: unpaid wages, grievance letter

Dear Forum Members,



Unfortunately, I need to send a formal grievance letter to my previous employer as they failed to pay me any wages and I could not resolve the issue by talking to my line manager. I have formulated a grievance letter, although I have no legal background whatsoever. Can you please advise, would this do as a first step?







Dear Sir/Madam,



I write further to previous communication, and formally request that you provide me with my wages in accordance with the Employment Rights Act 1996 and the National Minimum Wage Act 1998. As an employer, you are in contractual obligation to pay me the correct amount of wages, at the time that is agreed in the contract of employment.



I worked for company name – (address of work, period of work, job title). My staff number is: xxx. While still on probation period, I notified my line manager in writing that I wanted to resign from this position and worked through the 7 days notice period according to the contract of employment.



However, the company breached the contract of employment by failing to pay me any wages and failing to provide a pay slip; therefore contravened Section 13 of the Employment Rights Act.



I contacted my line manager, name, on date (the day after the payment was due) and notified her that I was not paid any wages. I stated that if this is due to a mistake, she should rectify this mistake as a matter of urgency and pay me my wages. She sent me a text message on my mobile phone on date stating that she is only willing to pay 70% of what she owes me due to tax purposes and only at a later date. This is unacceptable. She should issue me with my full pay and provide a detailed pay slip. I submitted a P45 tax declaration form to the company prior to commencing my employment.



The company is liable for any financial loss that I incur as a result of failure to pay me.



This is a step one letter in the statutory grievance procedure.



Please issue me with my full pay immediately.

Hoping someone can help with some info on where I stand on the below.



In March 2014 I agreed to lease a car from a company for c£300 pm. I confirmed by acceptance of this price via email.



In May I was sent the T&Cs to sign and returned the document via post. The lease company confirmed that they had received my documents and that they had signed an identical copy of the T&Cs. I was informed I had 14 days from the date of signing the agreement to change my mind and back out. The price on the agreement was incorrect but I as so much time had passed between agreeing the lease and the documents being sent, I did not realize (as it turns out, the price was lower than the amount agreed in March).



In June the company realized that the T&Cs I had signed were not correct and sent out some other documents for me to sign (this was after the 14 days had passed). The price did not change, just the T&Cs. They told me the previous agreement was null and void and the new T&Cs replaced them. Again I received an email confirming receipt of the document and that they had signed the agreement as well.



In September having taken delivery of the car, I received my first invoice. This was for the amount that I originally agreed and therefore more than the amount I signed for within the lease agreement / T&Cs. It turns out the T&Cs I had signed the second time around were still not correct as they sated that VAT was included when in fact the price quoted should have been ex VAT (this accounts of the difference in price between the agreed and the price on the document I signed).



Legally, where do I stand on this? Do the lease company have to honor the agreement that was signed by both parties (given the fact that they had 2 bites at the cherry and clearly didn't read the document they signed, I am hopeful that I am in the right!).

Part time work holiday entitlement question

Hi everyone, I'm new to the forum so sorry to just jump in with a question.



My other half believes that she might not be getting her full holiday entitlement and this may have been the case for a few years.



We have tried the holiday calculator on the .gov site but we found the syntax a little confusing.



Basically she's a hairdresser who works in a salon, her weekly days and hours are as follows:



Wed - 9am - 3 pm (5.5 hours)
Thurs - 9am -3pm (5.5 hours)

Fri - 9am - 5pm (7 hours)

Sat - 8.30 - 12.30 (4 hours)


The hours per day are in brackets and are excluding her lunch break for which she doesn't get paid. So basically she works 22hrs per week. She also gets one Saturday off in every four weeks - so this would come down to 18hrs. Her employer says she's entitled to 15.5 days paid leave per annum - does anyone know if this is correct? My other half has approached the lady in charge of this and she's adamant that's she is correct.

Hi one and all - Motormile Finance (MMF) - let’s begin:





Just to share with you all something, shortly, I came across concerning Motormile Finance when I was doing some detailed research into this group. Especially note the bit at the bottom concerning DVLA and MMF.






Like many others MMF have been auto dialling my landline since the earlier part of this year – won’t be too specific, no intention of helping MMF's prying eyes – calling sometimes daily, sometimes every other day.





Their normal, as reported elsewhere, intrusion is a pre-recorded message “This is motormile finance…this is a message for (name and surname - NOT ME or any other occupants at this address) we need you to contact us urgently…on 0113 8876876…quoting reference M******* etc”






Well tedious as MMF is let me explain, they really are not that bright. However, beware; they are rather cunning.





I have no debts with payday loans etc, or MMF itself – MMF has wrongly been dialling away on my number for a good several months now, starting with the threatening ‘Mike will be calling to your property’ and recently changing to the ‘Contact us urgently’. Yes, I do have debts but these are currently being dealt with by the best of the best legal advisor; all my debts are accounted for and MMF is nowhere at all in my particular picture. But as a study, MMF is a curious creature.





In their erroneous calls to my landline a pattern began to emerge. The day’s calls will start with the MMF message ‘contact us urgently’.






MMF calls would, within an hour or two, (sometimes sooner) be followed up with an ‘International’: call rings briefly, detects answer phone hangs up.






This set menu can then be followed by an ‘Unavailable’ call; rings briefly, detects answer phone hangs up.





Next we will receive the pre-recorded calls ‘offer free government help for insulation, new boiler etc’ ‘press 5…press 9’. Normally there is no caller ID BUT guess what….this call came through the other day on: telephone number 0113 278 0844. After quite some research this originates from.... where do you think…..? Well, it originates from Stanningley, Pudsey, LS28 6AT. Yep, same immediate area as MMF. Coincidence? Maybe, maybe not.





And as a final gesture we then had the pre-recorded ‘Did you know…you can write off such and such of you debts…press 5..’





Hmm….pattern?….MMF?…varied follow on pre-recorded ‘press the button’ calls (i.e.) confirm you are there…crude psychology…hmm.. maybe…doesn’t work though for me. Been there, done that, MMF; old hand here, battle hardened, you know.






BUT their attempts at cunningness did spur some further research and produces a question or two regarding their possible telephone harassment campaigns and questionable reasons for some specific data gathering from government sources by the likes of MMF.

Why do I bother to pursue this?


Well, everyone (MMF too, if you are looking in), people’s personal data was, at one time supposedly protected by legislation, telecommunications also, any abuse of, was also supposedly protected by legislation. The fact is – let’s be clear – there is no such protection in place (yes, you may well rub your hands,MMF); MMF will continue to call me tomorrow (about someone else’s debt), they will use their ‘sequential’ calls believing it will cause me a meltdown (yawn) and my post haste ringing them to plead with them to set up a repayment plan (on a debt I do not owe) and all this because the system allows it. Shouldn’t be so…but there you go.





‘Why don’t you…’ you began to say to me ‘..ring them, tell them their error..’ (pause for long silence….eyebrows up, eyebrows down…ring a debt collector, help them out…I’ll pass on that one..) ‘..well how about TPS, FSA, Trading Standards…’ you say. Hmm, have a go yourself nice; quite a journey, but no destination.



No, the only way is to be kept abreast of the ever changing MO of the likes of MMF and others. All updates can be useful, I hope this might be.



How DO these groups get and keep their operating licences? Baffles me completely. Life goes on, threats will continue. As will my research.



Bye the bye – I am toying with selectively setting, in targeted hours, (you are very predictable, MMF) my land line phone, which I stopped using a couple of years back, to redirect incoming calls from one MMF line to divert simultaneously to another MMF line; perfectly possible. If I get very bored with MMF’s antics I may just do this in short bursts. Oh,if you are present MMF...same time, same place tomorrow - don't be late...make sure you pay your phone bill...wouldn't want 'Mike' turning up now, would you?

Old Halifax Mortgage Question

Hope some mortgage experts on here can kindly assist.



My OH and I took out our first mortgage in 1990 (100% repayment) and we were sold a 25 year Standard Life policy through a Halifax Property Services agent, who advised that it was compulsory at the time for the mortgage to be agreed.



We got into some financial difficulties in early 2000 and the direct debit was cancelled and never reinstated. I also don't recall ever hearing anything from the Halifax or Standard Life regarding further payments.



I have now located the relevant policy details with relevant policy numbers and various HPS letters regarding the sale.



Now before I go any further, was the advice by the HPS agent / Standard Life representative correct in what he said ? Or is this a form of miss-selling and we could have sought other alternatives ?



If so who do I contact with complaint ?

Old Halifax Mortgage Question

PPI or not

hi all,

not sure if this post is in the correct place ,

my partner has just cancelled a "one bill account payment protection plan application form" that’s what it says on the contract we ask them to send a copy of.

my partner pays money way (one bill) secure trust bank ))))) a lump sum every month and they pay all the bills car utility and mortgage etc.

the policy she never had any idea about was 175 per month to cover wages or bills not quite sure.

As soon as she found out she stopped it and asked for a copy of the contract and statements of payments for this policy she went on to say I think you have miss sold this to me as I do not remember this and would of never paid 175 per month for 8 years I will make a complaint.

when she first used money way a rep came around and lots of forms got signed you know what I mean . in the first instance she denies all knowledge of this contract.



it was filled out and signed by my partner. 2006 Aug 2014 sept..



I called FSA they said its bill protection insurance BPI lol dose not fall under the same umbrella as ppi comp but can still claim on the same grounds with same time frames etc.

after calling money way sept 11 they agreed to investigate and send copy’s ..we are still waiting on first 3 years statements of payments made as insurance company changed 5 years ago and they can not locate them. my partner was not notified and never seen anything on the monthly statement or annual re: ppi bpi insurance policy she was paying for.



to back up this argument she never had a clue what she was signing it must of been slipped in.



1.there was never any mention of how much and when to pay from rep. (payments have gone up and down over 8 years ..130s..175s..

2. xs marked the places were to sign and fill out the form. not sure if this is good practice

3. after my partner signed it someone else signed it 7 days later and circled products required e.g. a b c. blatant diff hand writing

4. cover was for a Max 300 per week her bills are 1400 1500 per month

5. it states on the contract you can not claim if you haven’t been in full time employment for 12 months min.. it asked how long have you been in full time employment on the form she answered " - " as she was part time.

she would of never been able to claim on point 5 . taking money for 1 year with out being able to claim is mis sold . I am aware policy’s can take 100 days before you can claim on them not 360 .

6. not long after the policy started she was self employed with three children

7. no cooling off time was stated

8. was never advised to shop around for a better quote as no amount was ever discussed.

9. no ppi ever showed up on monthly statements

10. letter recived from money way says “”we are now looking into your “PPI” complaint””



has anyone ever come across this mis sold BPI any one ever had any dealings with secure trust bank was on there web site and they boast they have the least ppi claims and can do a 4 week turn around blarr blarr blar

Council Tax Problems/Bristow Sutor Bailiff's

Hi, my name's Chris and I have just joined.



I have been having some problems recently. I have OCD and had a major relapse earlier in the year - I was a bit of a mess and struggled to leave the house for a few months.



I'm OK now, but got behind on a lot of my bills. I'm currently paying various people back now. The people I'm having the problem with, ironically, isn't the corporations but my council.



They sent me a letter, around April, saying I hadn't paid my tax in a few months so they were taking it to a magistrate court. I'm pretty sure I had actually, but won't deny I fell behind. Cleverly, they removed my account from the web around the same time so I can't check.



Anyway, the last bill said they wanted £817 which is the entire 2014 bill for a single occupancy. I offered to pay it back at £100 a month which they a guy in an e-mail reply said was fine. And then they just went ahead with the magistrate thing anyway. As I said, I wasn't well at this time, and just gave up - I let it go to court, and would live with the concequences.



I didn't hear anything else for a while - then large chunks of money started coming out of my salary, under "council tax 1 deductions". I assume they got this through the magistrate order. It was around £270 per month. This was more than double what I wanted to pay. and it almost cost me my home - I couldn't pay rent. I told the council this in a letter/e-mail but they just ignored me and carried on taking it.



The deductions stopped after 2/3 months. So they took either £570 or the full £817. I'm checking this now, but it's certainly at least 2 deductions as I have the payslips in front of me.



Anyway, by now I'm completely lose on where I am. They didn't even tell me what the decuctions were, or that they were coming. Or what happened in the magistrate case. The money just came out. How much have I paid, how much do I owe? Do they owe me money?!



Then within weeks I get another letter from a debt collection agent called Bristow Sutor, asking for the full £817 again!



I e-mail them, telling them I have already paid the council a substancial amount of it, if not all of my debt, via salary deduction. I'm assuming it's a clerical error. But they just ignore me.



I then write to the council, saying the same thing, and for them to clear it up, and they ignore me.



I believe I wrote to both again, with the same message, disputing the debt and telling them what had happened, and they don't respond. In the meantime, Bristow and Sutor continue to escalate the debt.



I get a "notice prior to enforcement visit" from Bristow and Sutor, so I write to both again, explaining the situation, and asking for my financial information (what I've paid) by Bristol City Council - sending to both. Again, they both ignore me. I've heard nothing.



Then, literally 24 hours after I received the ""notice prior to enforcement visit" I get a bailiff visit. I can only assume they put the letter in the 2nd class post, and the bailiff used the letter date (not the arrival date) as the 7 days. The irony being, I was going to use the 7 days to contact them again to dispute again!



The original final demand bill from the council was £817 paid within 7 days- this was a demand for the entire year in advance, basically.



I have paid at least £540 through salary deductions since then. Possibly even £800+.



Now the bill I have is for £1100...........Bristow Sutor are now charging me the entire £817 again, plus over £300 in fees. Even though I've been sending letters, asking for info, and disputing it from the start. They or the council haven't replied to any of my letters or questions.



It seems the council and bailiff have just been ignoring everything I say, so they can escalate it to a point that puts me under pressure.



Is this legal? I have no idea about any of this. And thought I'd been acting quite fairly - writing to them, and pointing out what's wrong, and why I dispute it (ie I don't owe the council £817)



I'm sorry if I have gone on a bit. Maybe they're not acting as bad as I think - one of the quirks of OCD is panicking, and getting down about things quite quickly.

Hi,

Im looking for some advice or help. I submitted a claim through the moneyclaim online service. I made a mistake on the form and ticked the box to say i would send "particulars of the claim" to the defendant separetly. However my mistake i didnt read that bit and failed to send them to the defendant. The defendant has filed to set the case aside ( or have it struck out) , i called the court this morning and they advised there will be a hearing which i need to attend. Does anyone have any idea if the claim will be struck out or what i should do to save the situation?

Deceased died intestate.

Daughter acting as administrator.

Total value of estate a nominal £2500, so no probate required.

Funeral will be £1950.



Obviously, funeral expenses are settled first, but what of the other creditors? Is there a pecking order, or is it pro-rata? In no particular order, these are the bills:



Gas (£ unknown).

Water (£ unknown).

Electric (£ unknown).

Council tax (£ unknown).

House clearance (approx £100).

Administrators expenses (approx £200).

Housing Association rent (£ unknown).

Warden charge (£ unknown).

Nursing Home (partially assisted only. Approx £860).



It's clear that the estate is going to go bankrupt, so there's going to be a row (the Health Authority have already tried to con the daughter into signing a document stating that she accepts liability for the debts of the deceased).

Background Screening - Credit Checks

Hi all



I have been offered a job dependant on credit checks. I am happy with the credit checks being done (I understand lots of places do that know), however, I was just curious to know what a Background Screening company can see? Is it just the major things like:-






  • CCJ'S

  • Bankrupcies

  • IVA's

  • Adress History

  • Personal Info






Can they see payment history etc? I am unsure why they would need to see a run down of my entire report if it came back with none of the major issues mnetioned above?



Any help appreciated, tearing my hair out waiting for this job offer to be confirm, although I have signed contracts etc.

Background Screening - Credit Checks

Too many cortisone injections

Hi all - bit of advice if possible please.



I have had problems with my shoulder (torn rotator cuff) since a fall in 2003, having had several physio sessions at various times over 4 years which didn't help, so it was decided that I would benefit from cortisone injections to relieve the pain. I was warned that the injections may weaken the injection site but was never told that there was a recommended limit of 3 injections. I had in the region of 12 injections before my GP decided that I needed surgery, which I had on 22nd July 2014. I have now found out that I should never have been given so many, and because I had so many it may have caused more problems - I had an accident at work which resulted in a torn bicep tendon which may have been caused by the amount of injections weakening the site.



Do I have any recourse as surely the GP's shouldn't have given me so many injections?

Too many cortisone injections

12 year old non domestic rates debt

I received a shock of a telephone call on Friday from a withheld number .calling from my local council chasing unpaid business rates from 2002 , 2003 and 2004 from a pub I used to run although I left it in September 2003 as I could not afford the rent anymore. I was completely unaware of the debt and I have no idea what my next move should be and would appreciate any advice and experience.


The pub tenancy was a horrible financial mess and it barely turned over anything and I slowly paid off all debts I owed to the pub company for rent and utility companies between 2003 and 2008 and I just don’t understand how I could be on the electoral roll with the same council and only receive a bill ten years later for non domestic rates



I requested a printed copy of the bill and got that this morning and talked it through with them and got dates of liability orders etc although I haven’t seen a copy of the liability orders.




Outstanding bill was broken down to me verbally as follows although in print it just lists a total for 2004/05




2002/03 year £2051 . Liability order obtained March 2003




2003/04 year £3074 . Liabiity order obtained June 2003




2004/05 year £1933 . Liability order obtained June 2004




I left in Sept 2003 but the council lady on the phone today told me it was my onus to prove I hold no responsibility from that date. I hold no paperwork from 12 years ago and the pub company doesn’t exist anymore as it was a smaller one that went under in 2007. I went through a bad time after leaving owing so much and stayed
friends sofas until July 2004 when I was given a council flat and have been on the electoral roll with the same council ever since then so more than ten years and have never been approached about this what so ever. My credit record is completely clear even thought they say liability orders were issued. I know this because I moved in June this year (2014) and ordered an Equifax report and it came up as no debts




My situation now is that I am a single parent to a 9 year old. I have started my own business but only earned £4000 last tax year as I am paying off a small business setup loan of £15000 at £600 a month which wont be paid off until June 2016.
My household income is £16000 including tax credit , a small amount of housing benefit and earnings . My outgoings on rent , , council tax , utilities and school dinners/moderate groceries are £1200 leaving £130 a month for busfare and incidentals like school trips , birthdays , toiletries and sundries. Once the loan is paid off then I will have an additional 12k earning but that wont happen for 18 months.




Panicking madly at what my next move should be. The debt has no bailiffs charges etc added so has somehow gone 12 years without being passed on. Should I seek debt advice or try and sort out a payment plan directly with the council
or do something else . I can’t imagine that saying I can afford £10 a week will cut the mustard with a business rate debt so large but anything else will sink my current business and send me bankrupt .




Any advice at all would be so appreciated- feel sick with worry

Help with rather sticky situation

Hi Everyone,



first of all, all help and advice will be greatly appreciated as there's a lot going on with this my situation.



so my fiancée works for a small local LTD company and has done for the past 3 years. on Wednesday the 17th September she was placed on suspension with full pay however she

- wasn't given a written letter to confirm this

- wasn't given a reason to why she was being suspended

- had her personal laptop taken off her (the company couldn't afford one so they asked her to use hers)



now on the 19th (friday) she hand delivered a letter to the company owner with a witness and a police officer (as a separate criminal charge is being brought against the company) which stated that she wished to discuss some grievances including the reasons for suspension and other things such as having no employment contract even though she requested it more than once.

from then she has played the waiting game to see if she

A. Gets her wages and

B. if the boss replies to the grievance



now I know that she has to wait 28 days from the start of the grievance which would place the date to get back or take it to a tribunal on the 18th of October however she also hasnt been paid her wages as of today (last day of the month). does this give her reason to claim constructive dismissal as the other employees got paid nearly a week ago and shes had no update about the suspension and no letter about the grievance.



My personal feeling is to drop off 3 letters tomorrow (on the 1st) which are for



1. grievance reminder as she is legally obliged to reply to

2. grievance about unfair suspension without updates

3. 100% unlawful deduction of wages to be paid within 7 days and with a letter explaining the reason for late wages.



then once the 28 days passes then log a complaint for constructive dismissal

Hi there,



I've been through the process of reclaiming mis-sold PPI through Welcome Finance

for two loans (pre Jan 2005), and have received their compensation calculations.
