They sold my car without my knowledge

I try to keep it simple. I had non-fault accident in December14.

called accident management company.

they arranged recovery of vehicle to their storage

they arranged hire car, solicitor for personal inj, engineer report,

they asked me for certificate of insurance and V5 (i naively given them)

Engineer report says TOTAL LOSS. report forwarded to third party insurance they think it is repairable.

in mean time I received letter from DVLA saying we are no longer registered keeper.

so they claim management company sold the car before waiting for me to get paid.

I called police, they went to that company and informed me this is a civil matter not car theft because in one of the papers I signed it says:

I Mr .... confirm I have read the engineer report relating to this accident and I am happy with its content and I undrestand that I will not retain the salvage.

Police thinks this is enough for them to sell the salvage.



1- car is salvage when third party insurance agree and pay for that

2- before that, it should be kept in storage and treated as repairable car

3- car was in my wife's name ,they knew that (in V5) I can not give them authority to sell it

4- car has 40K outstanding finance, they were aware of this, but still sold that

5- Although I signed the paper, it was different from what he explained to me, I have the telephone conversation recorded and they confirmed we agreed that we can keep the salvage (after I signed the papers )



I informed finance company, and they want me to pay the settlement figure (not very helpful) they are not willing to get involve in recovering the car which is now repaired and is on the street.

Hello apologies if this in the wrong place.



I i have a consent order set up with BW Legal with thanks to this site, and I have a standing order set up to pay them the required amount each month.



I am meant to make a payment the first of every month but I set a standing order up for the 27th of each month so it would give me a few days to clear however this month ive completely forgot its a short month!

The payment left my bank on the 27th but I don't know how long it takes to clear. I don't want to break the terms of my consent order due to this. Will they take me straight back to court if the payment doesnt come through to them tomorrow?



Any help would be appreicated

Disciplinary hearing for gross misconduct

I really need some advice. I have been employed for 6 months and after 5 months all staff were advised of being placed on redundancy notice. Most people had given up like myself long standing jobs to join this company. Anyway, those I trained with have a closed Facebook group and we ranted on this group page which was only open to the 10 people in the group. One of these has taken it upon themselves to report myself and another staff member but not before deleting all their own comments. In the rant we said we were going to not work at full capacity as we felt the company had betrayed us. We did not carry out any of the actions and 2 of us have attended initial investigatory hearings to tell our employers it was merely a rant in what we thought was a closed group. Our employers have been told that the conversation they were handed is an edited version and they have not seen the other persons comments which goaded us onto saying what we did. They have now decided to instigate formal disciplinary action for gross misconduct. Is there any way they may consider a final written warning as they did not have the full facts? I intend to hand in my notice immediately after this has finished but am trying to maintain a reference that does not state sacked for gross misconduct. Any help would be greatly appreciated. I called Halifax today to get my policy numbers which had PPI, but they never included 2 loans which i took out years ago they do not have records apparently, the loans were taken out at my local branch of Halifax and with a member of the Halifax staff, but i remember that because i did not qualify for a Halifax loan, but I could get a loan with, which i can only describe as a sister company of Halifax, but cannot remember the name of the loan company, again it was all set up and agreed in Halifax bank and with Halifax staff.

Living in Scotland - DCA attempting to recover under Limitations Act (England/Wales)

Hi Everyone



I live in Scotland and I have been contacted by a Debt Collection Agency in England who are trying to recover a debt for a credit card that I feel would be Statute Barred under The Prescription and Limitations (Scotland) Act 1973, Part 1: Prescription, Section 6.



They are stating that a payment was made by myself to the creditor in April 2009 with the credit card then being defaulted at the end of April 2009 and that the Limitation Act 1980 would therefore apply, as at this current time 6 years would not have passed, although I thought this Act would be for England and Wales only.



As I have always lived in Scotland, does the Limitation Act 1980 apply to me, I have not made any payments since the default or acknowledged any debt to the creditor and the creditor has not been in touch within the 5 year period?



I emailed the DCA to request proof of the original contract and they have just sent through a photocopy of an apparent "online" credit agreement, this does not have a signature, merely a check box adjacent to the word Signature and a date of April 2007.

Living in Scotland - DCA attempting to recover under Limitations Act (England/Wales)

Marstons and TV License Fine

Hi



Just after some advice if possible,



I had a TV license fine from an old previous previous address which Marstons were previously sent to collect, this was maybe a year ago.



At the time with all their fees etc there was no way for me to pay it , the bailiff called a few times at 6:30am in the morning, refused to leave the premises when he was told he wouldn't be coming in and I couldn't pay unless it was installments (we were on a low income and in a housing association property), the bailiff straight out refused installments etc. etc after a few complaints to Marstons offices I was allowed to pay the fine off in installments, so paid it and thought great that was the end of it.



Today (Saturday 27th) at 12.25pm I had the same bailiff from Marstons knock on the door, I didn't open the door or speak to him, totally ignored he was there as I am at home alone with my 3 year old and didn't feel comfortable openong the door or speaking with him ( he is easily 6ft+ tall and looks like a a biker!)



After a while he put a letter through the postbox and left.









Basically says I still owe the court £70, I have just dug out my records and it does seem I calculated wrong somewhere with the installments and missed the last one!



What can I do to get this sorted? this is the first I have heard that I still owe an installment, My partner and I are currently on Income Based JSA and full HB allowance, there is absolutely no way I can pay this with the added fees, even the £70 straight to the court wouldn't be possible unless it was by low installments.



Do I have a leg to stand on anywhere? I really don't know what to do and really don't want him coming round again as it was pretty un-nerving for us.

Marstons and TV License Fine

Dismissed for Gross Misconduct, need advice how to proceed...

Ok this may be a long story but I will keep it brief. I work in a busy retail environment where we also do bag wraps, but these units are a few metres away from the tills. I completed a bag wrap for £10, went to process the bag wrap but the customer left before I could give a receipt. Another customer was in a rush and was being quite loud about it, so before I got the chance to process the £10 I went over to the customer to talk to him and let him know I have his attention. Told him the prices etc and tried to walk to process the money in my hand, every time though he was being difficult and kept saying please hurry. I decided fine, ill quickly do his bag wraps. One bag was particular heavy, weighed about 30kg, so I placed the money in my pocket to put it ontop the unit. Took the £10 straight away and resumed wrapping. Went over to the till with the customer, however, when i saw a pile of receipts the last one being £10. I had a lapse in memory and couldn't remember if that was mine. I asked my coworker if that was his, he couldnt say. He doesnt offer customers their receipts.



Anyway so i placed the £10 in the till thinking the receipt was the £10 i had in my hand. Processed the customers money. Waited a while for things to be quiet informed my coworker, he essentially accused me of stealing. He contacted supervisor, they reviewed the banking and everything else. Found the £10 was in the till, not stolen just not processed correctly. I was called in the office at the end of the week, was informed I will be suspended pending investigation, allegations of theft, missappropriation of money and unable to process a bag wrap transaction. 1 month later, HR lady get in touch and drops the theft allegation but leaves the other ones. I spoke to my manager and HR lady, my manager says if he being honest, itll probably be final written warning I wont get sacked. HR lady says this would normally be a minor or serious misconduct not a gross misconduct. Now I had the disciplinary hearing after it was cancelled twice on her account, one she didnt turn up and second she didnt bring the evidence I requested. Final meeting she didnt turn up, I couldnt wait any longer so I proceeded without her, Got a letter a week later, saying she has decided to dismiss me. I can appeal if I like toso it says on the letter. But I want to get your guys opinion on this.



On a side note, before you say putting money in your pocket is dodgy, I know that but I only did so after recieving this kind of training from my supervisor and coworkers. They have said that the kiosk where we work, the tills are far away so supervisors and managers dont expect us to keep running back and forth from the tills and units. I have 8 years of experience in retail, just passed my probation period and now I have been sacked for essentially following my supervisor instruction and not having a copy of the procedures which I believe I should have been given.



Anyway advice how I can proceed please. I have never been through this before so any help would be greatly appreciated.

Manchester-based financial solutions company, Money Advice Group (MAG), has announced the sale of its debt management business, Kensington Financial Management Consultants, to a major UK debt solution provider.



All active debt management clients have been transferred, as well as 48 members of the Kensington team, along with the brand, website and trading name.



The Kensington debt management client base was purchased for an undisclosed sum.



Money Advice Group will now focus on the formal debt solutions sector such as personal insolvency, Individual Voluntary Agreements, protected Trust Deeds and Debt Arrangement Schemes. The transaction has created an investment fund to allow it to explore business development and acquisitions within this space. Under its Knightsbridge Insolvency Services brand, it is aiming to expand its client base in this sector in excess of 30,000 (from 20,000) within the next six months. Knightsbridge is one of the UK’s largest providers of personal insolvencies and provides Protected Trust Deeds for half of the Scottish market.



Stuart Parkin, founder and director at Money Advice Group, says: “The sale is the result of a comprehensive tender process, which included five months of research and negotiations. It will enable us to take advantage of the opportunities in the insolvencies industry with our Knightsbridge brand, specifically acquiring both medium-sized and large competitors and expanding into new markets.

I received a parking charge notice dated 16.6.13 for going over my time in their car park, which was free for the first two hours. I think I was over by only a few minutes no more than half hr which would have cost me under £2 to park there for that extra half hr. The latest letter I received in relation to this matter is from Debt Recovery Plus (DRP) dated 20.2.15 notice of intended enforcement - unpaid county court judgment £215. They have stated that if I do not pay £215 then they will advise parking eye to apply for a warrant of control to instruct an enforcement agent (bailiff) to collect payment from me. Can u please advise me on the same and what my rights are and whether they can recover the money? I have drafted a letter to them asking them to give me my day in court asking them to demonstrate that there was a contract, that they are entitled to receive the money (£215), that it isn't a penalty and finally that what they have asked for is a genuine pre-estimated loss. I haven't sent the letter yet, I have been informed by DRP that I have until the 6.3.15 to pay it. Please advise. Many thanks.

Were do I start... Basically last September I had my car taken by newlyns baliffs using a anpr van due to an unpaid de pcn from walthamforest council I had no knowledge of this ticket as i had had to leave the area due to domestic issue which is being handled by the courts i was miles away from home with my 6 year old son with no money to get home the bailff did not care and i was forced to payy 912 pounds, which i has to borrow. At the time the bailiff told me i had a pcn a car i used to own but with a different council so what i was paying would cover everything. My car was released to me. However on the 1st of January the same baliff came and took my car again for the pcn on my old car even tho he told me it was delt with in September. So for months I had no knowledge these people were on my back and they new I was not at the old address due to the previous dealing. I don't get how he relesed the car knowing he was going to come looking for it again. I live in the middle off no were with little public transport and no way of being able to pay anything. I filed a declaration that saying I was not aware of the ticket , but this was opposed by the council and the said it was worth noting that that the respondent was traced to the original address and the warrant was enforced, which is not true as I've not been to that address for over a year!

Hi Everyone,



Thanks for taking the time to read my situation.



Essentially, I'm similar to many others. The appointment I was offered was no use to me, as I was unavailable on that date, so I didn't proceed with making the payment. I sorted my passport in the next few days myself via the post office.



I cancelled the appointment over the phone but was advised that I still had to pay. By this point I was aware that it was all a scam. They were horrible over the phone and I told them politely where to go. They phoned once or twice again, sent a few emails which I ignored and went away on holiday - this was back in May-July.



I forgot all about the whole charade until I was contacted again on Christmas Eve insisting that I had until 18:00 to make a payment (yes, Merry Christmas to you too Richard).



Since then there's been a few more letters with further threats which I always took to be idle scare tactics.



The latest letter is a court claim form though.



I've been really busy with work and haven't taken the time I would have liked to fully research what I need to do. I spoke a few weeks ago with Citizens Advice (who weren't all that helpful), read plenty on Which? Martin Lewis, as well as this Forum etc.



Another problem I have is that I'm not at the address that BPS believe I'm at, so I'm getting my mail late.



I've just this evening realised that I'm 1 day over the 14 days that they want to respond to the claim form.



The total that they now claim that I owe is £202.60. that's the initial £117.60, a couple of late fees and a £25 court charge.



Obviously, on principle, I'm loathed to pay out for this - as I literally have nothing to show from the entire experience other than higher blood pressure! However, I do have concerns about having a CCJ against me. I've worked tirelessly in recent years to improve my credit score and I'm hoping to be applying for mortgages soon.

Hello there! Can anyone help us deal with my daughter's debt collectors please?

Hi everyone,

I joined your forum the other day to try and find out who CDUK were, as they keep leaving phone messages for my daughter.

I''m not that surprised to learn that they are a Debt Collection Agency, which along with Lowell Finance, are trying to get my daughter to repay money she owed to Ikano and very.co.uk respectively.

The trouble is, she's in her 3rd year at Uni, living away from home, and has no money to pay her creditors. She has managed to get bits of work when she's come home in the summers, but it's never been enough to enable her to clear any of the amounts outstanding. I don't know about the Ikano debt, which accrued through her use of a Newlook card, but the debt to very.co has increased rapidly due to them imposing financial penalties for missed payments on top of their already outrageous interest rates. I thought she'd explained her circumstances to them and that they'd agreed to shelve repayments until she finishes Uni but as we're now getting mail from Lowell, it seems the larger debt's been passed to them.

The Lowell debt is £1103 and the CDUK debt is £171, and of course she also owes the bank for her overdraft, which I think is about £2000, but they're not asking for that yet, thank god!

I know she's the one who should be sorting all this out, but she's up to her ears in Uni work to finish off her final year, and I'm the one getting the phone calls and nasty letters! She is applying for jobs as well to try and keep afloat but whatever she gets it will only be part-time so she's never going to have enough to pay off these amounts while she's studying, and the situation won't be much better after she's finished because then she'll also have the bank to pay back, plus rent, utilities and housekeeping to find, and if there's anything left over, she can pay me back all she's borrowed as well!

I just don't know what her best option is, and I'm worried that Lowell and CD will increase the amounts they want to recover if she doesn't contact them - CD say in their latest letter that 'Failure to pay this balance in full or contact us to set a plan within 7days will result in further and unnecessary communication.' Does 'unnecessary' mean they'll charge her for it?

I'd be very grateful for any advice on this.

And should you wish to keep up-to-date on their latest corporate chicanery, at the bottom of their last letter it says 'Collect Direct (UK) is a trading style of Teleperformance Limited, with a registered address in Bristol, whereas at the head of the letter they give their CD(UK) Leeds address. Errrmm... what the hell is a 'trading style' anyway???

enforcement notice - refusing to make arrangement

Hi, new to this site and in freefall panic.



My partner has received a notice of enforcement for a CCJ debt owed to the royal mail from a previous/folded business

She made an arrangement with the solicitors when the CCJ went thru last year but because of being unemployed (has been at home caring for her 2 year old son) has not been able to make payments, however she has now been working for 3 weeks and in a better position to start to reduce the debt.



Yesterday an enforcement notice arrived, we have to pay £4600 by Thurs 5th March or the bailiffs will visit. (Andrew Wilson)



We cannot raise that sort of money, she called the bailiffs asking to make an arrangement (as the enforcement notice clearly says"You must pay, or agree a payment arrangement with the enforcement agent, by 5th March:" but they have completely refused to make an arrangement at all, she also spoke to the solicitors who also refused.



We would probably be able to raise about £2k by next week and pay the remainder over the next 3 months but they refuse to negotiate.



Can you advise what our options are? We aren't well off, currently receive housing benefit and to be honest neither of us own possessions worth seizing to cover the debt! I work for myself in a small new business but am not making any profit yet. We are broke and have no family or friends we can ask.

Caught shoplifting in Boots

Ok, here goes.

I did something really really stupid today, I stole a nail varnish from Boots. I have never done anything like this before, and just have no idea what I was thinking. I bought some other goods and left the store. I got outside and totally panicked and was trying to think of a way to return it. I feel sick to my stomach and so went into another store opposite where they had a toilet, to be sick and try and work out what to do. I came out of the loo, and a security guard from boots approached me.

He had the packaging from the product, which I had left in the store, and explained that they had seen me on cctv, and that if I gave it back there would no further action. I broke down in the middle of the other store and eventually after apologising repeatedly and stating that I don't know why I did it, was off work sick with stress, I gave it back to him.

He said that was it and I should calm down and get myself a cup of tea somewhere or something, and kept telling me it was ok. The thing is he knew that I had bought another nail varnish amongst other things, as I paid at the counter with a card and used my advantage card. So he knows who I am all other relevant info.

So he told me to go on my way and he went in a different direction so that the shoppers didn't think I was being taken back to boots (he said this) and showed me so much more sympathy than I deserve. He also told me I wasn't being banned from Boots.

What I am really really worried about is, will the police find out about this? I am sick with worry as my husband is a police officer (I know I am the most stupid idiot known to man) and I am really concerned he is going to find out somehow. We are on rocky ground at the moment, and I don't think he would be able to forgive this of me. I am so very sorry and quite honestly don't know why I would risk doing something like this. My job also would be at risk if I got in trouble with the police. Please help, I'm beaide myself with worry. I'd appreciate any advice at all. Many thanks in advance.

Epson printer - cashback impossible to claim

Tempted by a £60 cash-back offer, I bought an Epson printer and some ink to go with it from Amazon in January. It was advertised as a cashback so long as I bought both qualifying printer and ink. Having received the order I registered with Epson and allowed them to use 'my details' and loaded up my Amaxon order acknowledgement as proof of purchase. Epson rejected this, so I loaded up my invoice which was again rejected. I contacted Amazon customer support who said that they would mail me my VAT invoice and that this would be proof of purchase. It never arrived. I called Amazon support and they promised me that they would email me my VAT invoice, they didn't.



I am so put out that on point of principle I won't be put off. What is my best course of action? I have fulfilled the requirements of the Epson campaign, they refuse to tell my why my documents are not acceptable and Amazon are yessing me to death over the VAT invoice. How do I compel Amazon? or alternatively have I enough ammo to lodge a claim in the small claims court?

My ex stayed in house and paid me monies to pay mortgage, She lived in the house that was ours for 7 years.

She has no remarried and he lived in the house too along with her 3 kids ( none are mine )



I recently found out last week, she has upped and moved to a new house.



Only my name is on the mortgage.



I have mentioned to her that i am selling the house as i dont want it.



She has nastily replied - "how can i sell it when its not mine to sell ""



I really am not sure what she means by this, They way i understand it, as its only in my name, and she's remarried and moved on, there is nothing at all she can do, or needs to do .

I have used this forum before to find help with a separate problem and have found the help and advice given excellent. I do not know what would have done without you ! However this matter is something different and wondered if anybody would be able to help ? This is my problem I have had this problem for quite a while now and nobody seems to want to help, or has given me solid advice. I have even been in touch with the financial ombudsman, all to no avail. Our problem started when my husband came out of work, he had been working as a joiner and we had received tax credits, everything was fine at this point. However when he came out of work he went to DWP to claim JSA when he was there he filled in all the forms etc, the adviser asked what his income was at that precise moment in time, which was only Working tax and Child tax (no wages as he had finished work) the advisor told him that as he was already receiving WT they would only pay us £13.00 per week and the £80.00 WT would make up the required amount to live on by law, this continued to be our income for the next few months.

However when he went back into work and tried to claim WT again they said they had overpaid us by approx. £2.100 yet when we explained we had only been receiving £13.00 from JSA they said there was nothing they could to about, and we are still paying it back to this day.

You see DWP had underpaid us by £80.00 per week and WT has overpaid us by £80.00 per week. So in retrospect DWP owe WT not us but we are having to pay this amount of money. I have wrote numerous letters yet nobody will help us. This amount of money is such a lot. If you could give me any advice. I would be extremely grateful. I wrote to dwp when this happened and this is what they replied with


When you claimed JSA in March 2011, you were in receipt of WTC of 88.94 per week, which was taken into account as income against your personal allowance rate of 102.75

As WTC continued to be paid until 9/9/2011, this continued to be treated as income received when assessing your JSA entitlement

Taking the guidance and legislation into I can confirm no arrears of JSA will be due to you for the period.

As you state you informed WTC that you had finished work, yet continued to recieve WTC, it was your responsibility to check with HMRC whether this was correct.

It is always the responsibility of the claimant to report a change in circumstances to the relevant department,on time, and to check any subsequent communications from that department to alert them of any possible discrepancies.




This letter was received on 13/3/13 and after this we have just reached a deadend and do not know what way to turn. Nobody seems to know what to do. Your advice is welcome and greatly appreciated.

I am wondering whether a solicitor would be able to help ? but this has been going on for so long and I no longer know what to do. The last letter I wrote was in Sept 14 and I did not even receive a reply. Do you think it has been so long that I can longer do anything ? I had given up hope that anything could be done, but after discovering this forum, i am hoping someone can help. I have been told to seek advice from a solicitor, but cannot afford any fees. I've read a few of the forum feeds on line and the advice seems solid and constructive, so here goes. I'd be really grateful for any advice as I'd like to try and pursue this if possible.



MBNA have just rejected my claim for mis-sold PPI. My credit card was originally taken out with the Abbey National in 2002 via postal application (I didn't remember this but MBNA have sent me a copy of the original AN application form where I had ticked the PPI box). My account was then automatically transferred to MBNA when they took over the management of the AN credit card accounts. I recall being advised by letter from AN at the time and reassured that no action was required from me as a new card would arrive and everything would remain as was other than the new card would be branded MBNA. I suppose I naively ticked the PPI box as I assumed it might be useful without thinking through the possible ramifications. Also, as the form stated AN "strongly recommended" I take out the PPI cover, at the time I probably assumed the card application would be declined if I didn't agree.



To cut a long story short, I haven't used the credit card for years and years although MBNA seem reluctant to give me information about the last transaction date so I don't actually know when I last used it (but I'm guessing about seven years++ ago). Anyway, having moved address numerous times and trying unsuccessfully to update MBNA with my new details - I couldn't pass the security checks as I hadn't used the card for so long - I gave up so had no statements forwarded to me for some time. However, I recently decided to do something about it and took direction from helpful Santander staff.



I assumed that as I wasn't using the card but was still making monthly repayments the balance would be healthy but unbeknown to me, the PPI premium was increasing each month and my monthly payments were not meeting the minimum required payments. The debit balance isn't wildly hideous although I assumed I would be in credit by now and not debit, not understanding the PPI premium was increasing each month.



Essentially the claim was rejected by MBNA as they had sight of the postal application and also said that although I was employed in a full time permanent position with an established UK business, that as I wasn't able to confirm the sick pay conditions relating to the that company at the time, the PPI would potentially have been required to meet my monthly repayments in the event of sickness/loss of employment.



Do you all agree that MBNA have made the correct decision and I have no recourse or do you feel I should try and progress this with the ombudsman? I absolutely acknowledge that I have been naive and should have paid more attention to my finances but as I wasn't using the card and was making monthly repayments (and still am) I put it to the back of my mind.



I'd be grateful for your thoughts, please.

Aggravated damages

Hi! Bought a cooker on line, it turned up and was badly damaged. A week later the replacement was the wrong one, this was collected about four days after that. A full refund is being processed. Would it be possible for me to claim aggravated damages for the extra cost of feeding my young family from the local pub and other eating houses at considerable extra cost. It looks to have cost me about £30 per day for the last 18 days. A new cooker was delivered by a different company, three days after the order and promptly installed.

I'm guessing small claim for the turmoil... in your experience worth the effort?

Bryan Carter/Lowell/O2 court claim

Hi everyone,

My son has had a court claim issued against him on 11/02/12015.

This is for an old O2 mobile phone account which he defaulted on when he was made redundant in 2009.

I have acknowledged the claim on line and filed to defend.

Also sent a CPR 31.14 to Bryan Carters, which they replied to in the usual way saying thy dispute my rights to request those documents etc.

I am about to sent the response out lined in your template.

I have attached copies of court claim and Carter response letter.

What do I do now and have I done everything right up to date?

I am having to sue a local garage, under SOGSA 1982, for breach of contract.

I am a litigant in person

I have new proof of the garages negligence,which only came to light after I put in my claim.



I have now been directed to supply a chronology of events to the court, can i add this new proof to this or should I apply to court to add it to my claim.



Its not about increasing damages, but it is strong proof that I know will positively strengthen my argument and therefore affect the outcome of the case.

- wonder if you can help?



I got a parking ticket at a train station car park a few weeks ago. I could have sworn the early payment period was 28 days, so paid my ticket like a good (you might say foolish) fellow. I have now received a letter back saying it should have been paid within 14 days and not 28 so they want the full amount. What are my options? I am sure they have camera evidence of the car being parked there without a ticket on it so my challenge is with having to pay the full fare. Is it an option to return the original cheque with a bit of a 'take it or leave it' on it? I was prepared to pay the original fee but now am somewhat irked at their bully boy tactics and a bit more willing to put up a fight.
